I believe SA-MP is not responsible for servers, since these are not hosted by SA-MP.
And if you're copying existing servers which has copyright, your server may be removed from the SA-MP Server list.

If you have to question whether what you're doing is legal or not, then you probably shouldn't be doing it. If that isn't the reason that you're asking then you don't really need to know the answer.
As far as I'm aware, SA-MP wouldn't get shut down because of the actions of one server, it'd be the server owner (and/or other people involved) that get(s) penalised. It wouldn't affect SA-MP unless lots and lots of server owners were using SA-MP to commit illegal activities.

A list of things a server owner could do which would be considered illegal:
1. Murder
2. Steal a car
3. Pirate digital content
4. Steal a baby
5. Steal a cat
6. Rob a midget
7. Steal from someone in a wheelchair
8. Take someones KFC
9. Stab someone in their big toe
10. Rape a man
That's the definitive list. Everything else should be legal.
