Impersonating a military officer or a Marine is not a crime at all unless it is used in fraud, exploiting the benefits of being a serviceman or military veteran.

The Stolen Valor act has been stricken by the courts and no longer exists, and that itself was only against wearing or claiming to have received military medals, badges, or uniforms. This was stricken by the courts because they believed it was a violation of freedom of speech.

You can pretend to be a Marine all you want, it just makes you look bad.
