You can scare them, but they might just let you talk and ignore you. Why would they listen to you, if you can't take action against them?

Again, thats hear say, as you can LEGALLY own a set of words. ******, legally owns the "set of words" called ******, the same as lets say, rockstar, legally owns the name Grand Theft Auto123,Vice,SA,IV,etc) so then no one can legally use the name again. Its called intellectual property

Intellectual property (IP) refers to creations of the mind: inventions, literary and artistic works, and symbols, names, images, and designs used in commerce.

Basicly, unless you register the name, theres nothing you really can do to scare them if there heart is set on using your name. theres nothing much you can do besides register the name

If you open a company, incorporate your company, as 9 times out of ten, most lawyes will include business name registration(TM/Copyright etc) for an added fee, your be looking around 600/700 for that total.

Or if you open a sole proprietorship, youd be in the same boat you are now, and still would have to register the name.

lol it means I have to spend more than 1k $'s? WTF? for the whole work I have many more plans with that name

Yes, opening a company has its fee's there's more if you dont, if you operate a business in canada, without being registered, your fined about 2,500+ give or take the nature, as you may also be looking at workplace insurance fines aswell.

I suggest you do abit of homework, before you continue.

Registering names, and opening business's is no easy task, it takes alot of work, and planning. Plus startup money.

If you where to file for a trademark on the name, what would you do? It'll more than likely be an immature minor who steals the name/script, and attempting to take them to court wouldn't get you anything or anywhere.

Rockstar do not own 'Grand Theft Auto' on it's own. For example it's the name of a felony in the states.

Correct, they own the combination of, Grand Theft Auto: SA(plus other titles) they dont own Grand Theft Auto, they own the combination of words with Grand Theft Auto.

Edit: Just because hes a minor, does not mean you wont get anywhere, anyone under 18, you can go after there parents, and as soon as the kids parents see legal notices, they freakout, and do everything they can to stop you, aka, stoping there child from using the name and such.

Yes, you can still take legal action, but there's also the fact of deciding if the child was aware of the legal implications of violating the trademark and then the cost of having to track a username down to a person.. And for all this over a game, which an owner thinks he's going to make $5k+ ? I don't see him actually taking this trademark any further than here, he already said he needed the domains cheap, I presume he doesn't have the finances to do anything else.

Scripts of the 10 servers will not be stolen because they will be hosted by me on a VPS of my friend and I trust him, And I will upload just the .amx never give the .pwn to anyone, Not even my father lol, My father is not in sa-mp

And I know if script gets stolen the name gets stolen but if someone uses NG-RP or any other script and just use my name and then my server reputition will be fucked up.

Enzo you took a lot of time for me thanks

Well as it's been postead above, broadly, everything that has popped out of your mind first (in law it's called "original work") on the world is your intellectual property. You, as the owner of that property, has several exclusive rights which are recognised in most jurisdictions all over the world.

One of them is copyright, which is applicable to any substantive information. It was originally the right to copy your work, but if you hold the copyright of the material, you can also adopt, display, sell the property. You, and only you, hence the name "exclusive rights". You can share these rights (creative commons) or you can waive it (pulbic domain). The full set of these rights can be found on the Wikipedia.

That's why we have patents, trademarks. Because the copyright is only one group of these rights, and it's only applicable for certain types of Intellectual Property. For example, patents are for inventions (you hold the right to recreate or sell the invention), trademarks are for smybols and words, phases, logos, etc.

The big difference between copyright & trademarks/patents is that the last two must be generally registered if you want to hold the trademark/patent rights.

All of the above is general, it varies by jurisdictions.
