If you where to file for a trademark on the name, what would you do? It'll more than likely be an immature minor who steals the name/script, and attempting to take them to court wouldn't get you anything or anywhere.

Rockstar do not own 'Grand Theft Auto' on it's own. For example it's the name of a felony in the states.
