If you take that literally, SA:MP by itself is not allowed to exist (republished, modified, distributed). Although, IIRC, the license of GTA SA itself (and thus not R*) didn't contain that part, allowing Kalcor to make this mod (which is also the reason why he never made a IV-MP).

Keep in mind that most ToS and Licenses are just to back them up legally if it ever makes it to court. The ToS of most games say you need to pause each 90 minutes you play. That's their defense if anyone gets sight flaws.

literally means any script made, each single server code within SA:MP is the intellectual property of SA-MP

Which contradicts the License of GTA SA, because they also "own" every expression made within their game.
