if someone launches his gamemod in gamemods scripts section. do i need any permission to make a server and launching it worldwide with that gamemode ?

this is all i need to know.

Well, logically to put it; if you don't want someone to use your gamemode then why release it?

Obviously you are allowed to make a server 'if' the gamemode is released with the coder's consent and isn't a leaked script. As long as you credit the coder then it's all good, such is not claiming you made it etc.
